Ahmedabad: Member of Muslim community Khambhat city has contacted Gujarat High Court Demanding the local police to either transfer the investigation to the CID (crime) or central bureau (CBI) in the FIR registered against the leaders who took out the procession Ram Navami There were communal flare-ups last month.
There were communal violence and incidents of looting, burning of private properties, houses and shops during the procession taken out on Ram Navami. Religious places were also damaged. Later, the Anand district administration launched a demolition drive and demolished the illegally established commercial establishments of the rioters.
The police registered two FIRs – one against the members of the Muslim community and the other against the members of the committee which took out the procession and the crowd of 1,000 people. The petitioners, who have approached the HC through advocate Anand Yagnik, claimed that the police have not arrested a single accused person till date, though their names are mentioned in the FIR.
“All the arrests that have been made are related to a section of the society i.e. minority. The investigation which has been done is one-sided on the basis of religious views and religious prejudice. Every day new arrests are being made in the first FIR while in the second FIR. , nothing happens. Every day new conspiracy theories are created with respect to the first FIR whereas despite the addition of sections 435, 436, 447 and 427 of IPC in the second FIR, the same police is deliberately investigating both the FIRs. is, willfully, maliciously, as a part of the colorful exercise of power, based on extra-legal and extra-constitutional considerations, takes no action in respect of offenses arising out of the second FIR,” the petition reads.
Alleging that the investigation by the Khambhat police was biased, clearly arbitrary and grossly discriminatory, the petitioners asked the HC to direct the police to file an FIR against the procession participants under sections 153A, 153B, 295 of the IPC. , 295A, 395 and 120B. ,
The plea has sought immediate arrest of the people and a direction to the government to provide compensation to the petitioners for the loss of their property. He has also urged the HC to direct “departmental, civil and criminal action against the erring officers responsible for non-transparent, unfair, discriminatory behavior in respect of both the FIRs”.
