Replace iPhone or get full refund: Court orders Apple Service Center in Bengaluru

One Apple Authorized service center allegedly refused to fix under-warranty of a youth from Chikkamagaluru iPhoneA Times of India report said. Now, Apple Service Center has been ordered by a Bengaluru court to give a free iPhone or equivalent money to the customer. Along with this, the service center has also been asked to pay a compensation of Rs 10,000 to the user for inconvenient service. The user, Atiq Anjum had received the iPhone as a gift from his brother in 2018. In May 2019, the user purchased an extended warranty for the iPhone from Apple, which was valid till August 2020, for the smartphone after paying Rs 4,500.

The iPhone, somehow, started getting touch and speaker related issues by July, and users came from Chikkamagaluru to an authorized Apple center in Koramangala, Ample Technologies Pvt Ltd, which is 250 km away. The matter went well and Anjum returned home. However, the next day his smartphone’s display started flashing green lights. He called Apple customer care and was advised to travel 250kms to hand over the phone to Ample Technologies again.

The second time around, while the screen was fixed, the speaker problem persisted. According to the report, technicians told Anjum that the speaker mesh inside the iPhone was damaged. After consultation with Apple, the user was told that it is not covered under warranty and that speaker damage is caused by external factors and is not a manufacturing defect.

This did not go down well with Anjum, who was given a bill of Rs 59,000 to fix the problem or replace the phone. He then sent legal notices to Apple and Ample Technologies, saying the parties were trying to bend the warranty terms to make an unlawful profit from the customer. In November 2019, he approached the Bengaluru Rural and Urban Additional District Consumer Disputes Redressal Forum with a complaint against Apple and Ample Technologies.

After months of hearings, the ruling was delivered on January 12, 2022, and consumer court judges held that the Apple Service Center should not have been serviced in the first place if the damage had been done. However, Apple and Ample Technologies demand that they fix the problem if the complainant agrees not to take free service for future hardware issues, and has to pay “explicitly”, according to the regulations. and violates the terms of warranty, for which the complainant had paid an additional amount in 2019.

The judges noted that both Apple and Ample technologies showed a deficiency in service because the parties failed to repair an actual customer’s equipment. The court eventually ruled that Apple India and Ample Technologies must replace the user’s damaged iPhone. If they cannot do so, they should refund Rs 92,000 of the cost of the handset along with interest. The court also ordered the customer to pay Rs 10,000 in damages for his court and other expenses.
