SC to hear plea to consider validity of NEET EWS quota in second week of May

petition regarding the validity of National Eligibility cum Entrance Test (NEET) The Supreme Court will hear the criteria for Economically Weaker Section (EWS) candidates in the second week of May. The criterion states Rs 8 lakh as the upper limit of annual income for availing EWS quota for admission in medical colleges.

NEET PG 2022 is scheduled for May 23, while the results will be out on May 30. Senior advocate Arvind Datar has requested Bench Justices DY Chandrachud and Bela M Trivedi to hear the matter urgently as they do not have much time left for the examination, Live Law reported.

On January 7, the Supreme Court had allowed the commencement of the counseling process for NEET PG and UG for admission to the 2021-22 academic session. This was on the basis of existing 27 per cent quota for Other Backward Classes (OBC) and 10 per cent reservation for EWS in All India Quota.

Subsequently, the court upheld the constitutionality of 27 per cent OBC reservation, while for EWS, the apex court said that the existing criterion of 10 per cent will be considered for admission in the current year so that there is no further delay in the admission process. The SC had listed the matter for March 2022 with respect to the norms laid down by the Pandey Committee for identification of EWS for future, while allowing the MCC to adhere to the norms and conduct counselling.

The Pandey committee, constituted by the Centre, had revised the criteria for EWS reservation. Following which, it recommended retaining the annual income criterion of Rs 8 lakh but excluding those families who have agricultural land of five acres or more, irrespective of their annual income. It also recommended removal of norms with respect to residential properties but said these amendments would be implemented from the next academic year.
