Prayagraj: Allahabad High Court granted him bail on Monday Shrikant Tyagiwho has been arrested for assaulting a woman Grand Omaxe Society of Noida In August this year.
The court had granted him bail in a case registered against him under the Gangster Act. The sessions court has already granted him bail in three other cases.
Allowing Tyagi’s bail application, Justice Surendra Singh said that since he has already been granted bail in other criminal cases, he is now entitled to bail in the case registered against him under the Gangster Act.
Tyagi’s counsel argued that he has been falsely implicated in the present case and is not a member of any gang. “He is in jail since August 9, 2022, and if he is extended on bail, he will not misuse it,” he said.
On the criminal history of seven cases registered against Tyagi between 2007 and 2022, the court said: “The counsel for the state has strongly opposed the prayer for bail, but he cannot accept the statement made by the counsel for the applicant with regard to the bail order.” Cannot deny the above. In addition to the above, final report has been submitted and judgment and order passed acquitting the applicant in the case mentioned against him.”
“Having regard to the facts and circumstances of the case, the nature of the charges, the gravity of the offence, the gravity of the sentence, the evidence to be produced in the case, the fact that the applicant is on bail in the original offence, and Section 19(4)(b) of the UP Gangsters and Anti-Social Activities (Prevention) Act, 1986 – but without expressing any opinion on the merits of the case – is of the opinion of this Court that the applicant is entitled to bail,” Justice Singh said.
Tyagi, who was arrested under relevant sections of the molestation, rioting, cheating and gangster act, is in judicial custody since August 9.
Tyagi sparked outrage across the country when he was seen in a widely circulated video of a woman molesting and misbehaving at his apartment complex, Grand Omaxe Society in Noida. According to the counsel for the applicant, since Tyagi has already got bail in other criminal cases registered against him, he will now be released after securing bail in the present case registered under the Gangster Act.
