Son’s murder: Transport operator released on bail

A Mangaluru court has granted bail to Rajesh Prabhu, owner of Vaishnavi Express Cargo Pvt Ltd, accused of killing his son.

On 2 November, 2nd Additional District and Sessions Judge Abhay Dhanpal Chowla granted bail to Prabhu and directed, among other things, to execute a bond of ₹1 lakh with two sureties. They have been asked not to tamper with evidence or contact any prosecution witnesses. They have also been directed to hand over their passports and weapons to the investigating officer.

On 5 October, after a heated argument with two employees, Prabhu fired twice with his licensed pistol. One bullet was fired at his 16-year-old son Sudheendra, who died on 8 October. Mangaluru South Police, which initially registered a case under sections 307 and 308 of the Indian Penal Code, dropped section 308 and inserted 302 (murder). Prabhu was arrested and was in police custody for three days before being taken to Mangaluru district jail.

In his regular bail application filed under Section 439 of the Code of Criminal Procedure, he argued that he had no intention to cause the death of his son. In addition, he is suffering from serious heart problems and needs medical attention. After the death of his son, his wife Shanta Prabhu is in severe depression.

Allowing his bail plea, the judge observed that the mere possession of a licensed pistol for personal protection at this pre-investigation stage is not a reason to conclude that Prabhu has committed sections 307 (attempt to murder), 304 (offender) not murder). murder amount) or 302 (murder). The judge considered the need for Prabhu to undergo further tests to rule out coronary artery disease and Shantala Prabhu’s health condition.
