Supreme Court asks CBI to probe medical condition of former Congress leader Sajjan Kumar

New DelhiThe Supreme Court on Tuesday directed the CBI to investigate the medical condition of former Congress leader Sajjan Kumar, who is serving a life sentence in the 1984 anti-Sikh riots case, and sought interim bail on health grounds.

A bench of Justices Sanjay Kishan Kaul and Hrishikesh Roy issued notice to CBI on Kumar’s plea and asked it to file an affidavit within a week after confirming his medical condition.

Senior advocate Vikas Singh, appearing for the former MP, said Kumar should be taken to a private hospital for treatment as his condition could not be ascertained in a government hospital here.

We want someone from the state to confirm this. We want the state to verify what the medical condition is, the bench said.

Singh said Kumar was earlier treated by a doctor at a private hospital and may be treated there.

Senior advocate Dushyant Dave, appearing for the complainant in the case, submitted that Kumar had got anticipatory bail from the High Court in 2010 and was sent to jail only after being convicted by the High Court.

It is shocking, he told the bench, that people were killed during the riots.

I have serious objections regarding private hospitals and these powerful accused, Dave said, adding that the apex court had in September last year rejected Kumar’s plea for interim bail on health grounds.

When Singh said that Kumar’s condition was very bad, Dave said he was examined by an AIIMS board in March last year.

Dave said that after killing people, they are all in a precarious position.

“It is a precarious position in itself that he is in jail. This in itself is a precarious situation,” the bench said.

As Singh said that irresponsible statements should not be made, Dave argued that “it is not irresponsible, it is a serious matter.

Singh said he had not argued anything on merit.

Issue notice. State attorneys accept the notice. The bench said that the medical condition of the petitioner should be verified and the affidavit should be filed within a week and the matter has been fixed for hearing on September 6.

Kumar is serving a life sentence after the Delhi High Court convicted him and others in the case on December 17, 2018.

The High Court had in 2013 overturned the acquittal of Kumar by the trial court, who had committed the murder and burning of five Sikhs in Raj Nagar Part-I area in south-west Delhi’s Palam Colony on November 1-2, 1984. was related to. A Gurdwara in Raj Nagar Part-II.

Riots broke out after the assassination of then Prime Minister Indira Gandhi by two of her Sikh bodyguards on 31 October 1984.

In its judgment, the high court had sentenced Kumar to imprisonment for “the remainder of his natural life” and held that the riots were a “crime against humanity”, enjoyed “political patronage” and “indifferent” by received help. ” law enforcement agency.
