new Delhi: Supreme court Eliminated the 10.5 percent reservation provided on Thursday oneiyarsoa most backward community (MBC) in Tamil Nadu, in government jobs and admission to educational institutions.
A bench of Justices L Nageswara Rao and BR Gavai upheld the Madras High Court order quashing the reservation.
The apex court said that caste can be a starting point but backwardness cannot be the sole basis for deciding whether to grant reservation.
“We are of the opinion that there is no sound basis for the classification of Vanniyakul Kshatriya MBCs in one group should be treated differently from the rest of the 115 communities within the groups and, therefore, the 2021 Act is in violation of Articles 14, 15 and 16 of the Constitution. Therefore, we uphold the decision of the High Court,” the bench said.
The Tamil Nadu Assembly passed the then ruling AIADMK-Pilot Bill in February last year, providing for an internal reservation of 10.5 per cent for Vaniyars, following which the DMK government issued an order for its implementation in July 2021.
It split the total 20 per cent reservation for MBCs and non-notified communities into three separate categories by regrouping castes and providing more than 10 per cent sub-quota for Vaniyars, formerly known as Vanniyakula Kshatriyas. Was known.
