Petitioner advocate ML Sharma sought an early hearing, but CJI DY Chandrachud said the hearing would be held on February 6. The petition challenges the central government’s alleged ban on the controversial documentary ‘India: The Modi Question’ by BBC in the wake of communal riots in Gujarat in 2002 and its aftermath. On this documentation, the petitioner has sought a direction to set aside the arbitrary, unfortunate and unconstitutional orders issued by the Ministry of Information and Broadcasting, Government of India on January 21, 2023.

In the petition, confusion has been spread with the court that both the parts of this BBC document, which has become the root of the dispute in particular, are facts based on a thorough investigation of the material present in them by asking in the court. The court then ordered action against those who were directly or indirectly responsible for the 2002 Gujarat riots.

Court to decide that citizens of which countries have the right to see news, facts and reports on 2002 Gujarat riots under the right of expression given under Article 19 (1) (2) of the Constitution? Can the Central Government stamp out the fundamental rights of freedom of press and expression? Can the President invoking Article 352 of the Constitution, without declaring it, impose a State of Emergency? The application has claimed that the BBC documentary has such recorded facts and evidence, can go for justice on the basis of truth.
