tribunal trouble

The Supreme Court on Monday slammed the government for the passage of the Tribunal Reforms Act, 2021 without debate in Parliament, saying it was a “virtual replication” of the provisions it struck down earlier. It also expressed its displeasure over the delay caused by the Center making top appointments in some tribunals. “No Respect” [for] The decision of this court,” Chief Justice NV Ramana said, “you are testing our patience.”

The new law not only gave the Center more authority over tribunal appointments, but also allowed it to reduce these domain-specialist dispute settlers, an objective that some legal analysts argue would be better served at the justice end because these The courts have grown too fast and created confusion. Our judiciary, however, has been keen to reduce the burden on the High Courts through tribunals and exercise control over the adjudicating staff. As an independent authority under the Constitution of India and its principal interpreter, the view of the apex court should prevail on how justice is delivered fairly. We cannot have procedures that compromise judicial autonomy in any way. The government needs to introspect in this matter.
