Court accepts Nawab Malik’s condition critical, will hear bail application next week

The Bombay High Court on Friday admitted that the condition of Nationalist Congress Party (NCP) leader Nawab Malik, arrested in an alleged money laundering case, was critical. Along with the court, it was agreed to hear his bail application on merits next week. Malik was arrested by the Enforcement Directorate (ED) on February 23, 2022, under the Prevention of Money Laundering Act (PMLA) in connection with an asset allocation case allegedly involving fugitive Ibrahim and his associates. He had moved the High Court last year requesting bail on medical grounds.

The Globe’s MS Karnik earlier this month quoted Malik as saying that he would first have to take the case to court as Malik’s condition was serious. After brief cross-examination by Malik’s lawyer Desai this week, Karierik acknowledged Friday that Malik was in a critical state of health.

The court said, “I am taking note that he is suffering from a serious medical condition. We will hear the matter on merits from next week.

Malik’s counsel Desai along with advocate Kushal Mor argued that Malik has been in jail for over a year. One of his kidney is damaged and the other kidney is not working properly.

“Courts take 2-3 weeks to grant permission for investigation, this should not work,” Desai said, pointing to the exception under Section 45 of the PMLA for cases where In which he is below 16 years of age or is a woman or is ill.

In May 2022, the special court for hearing cases related to the PMLA had denied him bail on medical grounds, but allowed him to be admitted to a private hospital for treatment.
