Court issues summons to Kejriwal, Sanjay Singh in PM degree case

The complainant alleged that the deposits were derogatory to the university.

A court in Manhara has acquitted Delhi’s Arvind Kejriwal and Aam Party (AAP) vote member Sanjay Singh with a complaint of criminal defamation filed against Gujarat University for allegedly making accusatory and defamatory statements regarding Prime Minister Narendra Modi’s academic degree. Summons has been issued. The court of Additional Chief Magistrate Jayeshbhai Chowtia on Saturday issued summons to the Metro to appear before the two AAP leaders on May 23. The court said that a prima facie case is made out against him under Section 500 (defamation) of the Indian Penal Code on the complaint of Gujarat University Registrar Piyush Patel.

The court also ordered the deletion of ‘Chief Minister’ from the name of the charger in the title of claim of the case, saying that he had made these statements in his personal capacity. The account holder and Singh had taken leave after the Gujarat High Court had ordered quashing of the Chief Information Commissioner’s order relating to information to Gujarat University on the Prime Minister’s degree. According to the complainant, they make “derogatory” statements regarding Modi’s degree at simple press conferences and on Twitter, targeted at the university. He said that his targeting of Gujarat University was disrespectful and harms the reputation of the institution which has made a name for itself among the public.

Amit Nair, counsel for the complainant, said that Gujarat University was established 70 years ago. Nair said that it has a reputation among the people and the opinion management of the authority would create mistrust about the university. The complainant alleged that the submissions were defamatory to the university as these were contradictory and aimed at maligning the reputation of the university. His intention was shared on the media and Twitter handle.

Referring to doubts about the documents, the complainant said, “If there is a degree and it is genuine then why is it not being shown? They are not giving the degree because it can be fake and if PM studied in Delhi University and Gujarat University then Gujarat University should celebrate that our students became the Prime Minister of the country.’ According to the complainant, Sanjay Singh had said, ‘ “They are trying to make the PM’s certificate degree genuine.”
