Maharashtra MLA Kadu gets interim bail after being sent to judicial custody

In 2018, Kadu allegedly misbehaved with an IAS officer by barging inside the cabin of an IAS officer at the Secretariat. The MLA along with some students had gone to lodge a protest against a competitive exam website, which was getting spoiled time and again.

After a magistrate’s court sent Maharashtra MLA Bacchu Kadu to judicial custody for 14 days, he was granted interim bail by a Mumbai sessions court in a 2018 case. The Girgaum Magistrate Court had issued a non-bailable warrant against him for his continuous absence from the court.

A case has been registered against Kadu at Marine Drive police station under sections 353 (assault or criminal force to prevent public servant from discharge of duty), 504 (intentional insult to provoke breach of the peace), and 506 (criminal intimidation) it was done. Indian Penal Code.

In 2018, Kadu allegedly abused an IAS officer by barging inside the cabin of an IAS officer at the Secretariat and allegedly threw his laptop at him. Kadu is said to have gone with some students to register a protest against a government competitive exam website which was not working again and again.

A charge sheet was filed against Kadu by Marine Drive police station on July 5 this year. The court took cognizance of the chargesheet issued and the summons to Kadu.

On 27 July 2022, the magistrate issued a non-bailable warrant. Subsequently, an arrest warrant was issued against Kadu as he was absent on that date. On August 17, the police filed a warrant status report and Kadu was still absent. On August 29, the warrant against Kadu was re-issued and the matter was adjourned for Wednesday.

Kadu appeared in the court and filed an application for cancellation of the non-bailable warrant. However, Magistrate Nadeem Patel sent him to judicial custody and his bail plea was rejected. Even the Public Prosecutor pointed out that since Section 353 is triable by Session, only the Sessions Court can grant bail to Kadu. This was the reason why the bail was rejected. Kadu’s lawyer Manoj Tekade immediately moved the Mumbai Sessions Court.

In the sessions court, Tekade submitted before special judge Rahul Rokade that Kadu was never arrested during the investigation, and was taken into custody as it was only a formality to cancel the warrant. He said that the four-time MLAs are permanent residents of Maharashtra and will not abscond. After hearing these things, Judge Rokade immediately granted him interim bail and kept the further hearing on the petition on September 21.

There are few such cases against Kadu and he was also sentenced to two months’ imprisonment by a court in Amaravati this year in a case.
